These terms cover the Emberday app, emberday.alkinum.com and our support service. “We” means Liao YuanPeng, an individual operating Emberday under the Alkinum brand, based in China. You can contact us at support@emberday.alkinum.com or through support. Please read these terms and our Privacy Policy before using the services. If you do not agree, do not use them. Nothing here removes rights that applicable law does not allow you to waive.

What Emberday provides
Emberday is a personal mood journal for recording feelings, adding notes and reviewing your own history. Optional features include places, private iCloud synchronization and on-device estimates based on information you choose to share from Apple Health. Availability depends on the app version, supported device and operating system, permissions, Apple services and network conditions. The website describes the current product; a feature announcement is not a promise of future delivery.
Personal reflection, not medical care
Emberday does not provide medical advice, diagnosis, treatment, prevention, emergency response or monitoring by a healthcare professional. Health estimates are not clinically validated, do not measure psychological stress and cannot establish or rule out a health condition. Mood scores, trends and suggestions are for your own reflection. Do not use them to make treatment decisions or delay professional care. Seek appropriate medical help for symptoms or concerns; in an emergency, contact local emergency services. Support messages are not monitored as an emergency channel.
Eligibility and responsible use
You must be able to agree to these terms under applicable law. Where parental or guardian permission is required, obtain it before use. Follow the age guidance and restrictions of your App Store region.
Use the services lawfully. Do not attack or disrupt the website, bypass access controls or abuse protections, impersonate others, access someone else's records, send malicious files or submit unlawful, abusive or unsolicited messages through support. Technical investigation permitted by law and rights granted by an applicable open-source license are not restricted by this paragraph. Report a suspected security issue privately through support without including other people's data.
Your content and choices
You retain your rights to your journal and other content. Emberday does not claim ownership of it. You are responsible for what you enter and for deciding what to share with support. By sending a support request, you allow us to use its content only as needed to handle it, operate and secure the support service, and meet legal obligations, as described in the Privacy Policy.
The app does not require an Emberday account. Protect your device, Apple account, authentication methods and backups. Enabling app lock limits interface access; it does not create an additional encryption layer. Optional permissions can be declined or revoked, although the relevant optional feature may then be unavailable.
Storage, synchronization and deletion
Your journal is stored on your device. iCloud synchronization is enabled by default when available and can be turned off in Settings. Apple supplies iCloud under its own terms. Synchronization is not an independent historical backup and does not guarantee recovery from deletion, account changes, outages or device loss. Keep any separate copies you need using methods available to you; do not assume support can restore your journal.
Read the deletion information in our Privacy Policy and guide. Removing the app or disabling sync does not by itself delete an existing iCloud copy. A cloud deletion may require connectivity and access to the correct Apple account; check the result and resolve reported errors. Optional place and health data have separate storage and deletion behavior. We cannot retrieve or delete private Apple data on your behalf.
App Store, payment and third-party services
Downloads, any applicable app purchase price, billing and refunds are handled by Apple under the terms shown in the App Store. The current app has no in-app purchases, subscriptions or advertising. No purchase is required to contact support. If paid features are introduced, their price and conditions will be disclosed before purchase.
The app distributed through the App Store is also subject to Apple's applicable Standard Licensed Application End User License Agreement, unless a valid custom license accompanies it, and Apple's platform terms. These website and service terms do not replace Apple’s agreement or applicable open-source licenses. Apple, iCloud, Maps and other third-party services are governed by their providers' terms and availability. Apple is not the operator of our support service.
Software, branding and website materials
Emberday source code is licensed under the Mozilla Public License 2.0. To request applicable license notices or corresponding source, contact support. Those licenses govern rights in covered code. They do not grant trademark rights in the Emberday or Alkinum names, logos or other branding. Website text and visual materials remain subject to their respective owners' rights, except where a separate license or applicable law permits reuse.
Availability and changes
We may maintain, update or discontinue parts of the website or support service and may restrict abusive or unlawful access. We will provide notice where required by law. We do not promise uninterrupted availability, a particular response time or compatibility with every future platform version. Changes to the app are delivered through its normal distribution channel. A support-service restriction does not give us control over your local journal.
Warranties and responsibility
To the extent permitted by law, the services are provided as available, without additional promises of uninterrupted or error-free operation, recovery of data, medical accuracy or fitness for a particular purpose. You are responsible for maintaining access to your devices and accounts and for decisions based on your records.
To the extent permitted by law, we are not responsible for indirect or consequential losses arising from use of the services, including losses caused by third-party service interruptions or failure to maintain your own copies. This does not exclude or limit liability for fraud, deliberate misconduct, negligence where liability cannot lawfully be excluded, or any mandatory consumer guarantee or other non-excludable right. Any remedy provided by applicable law or Apple's purchase terms remains available.
Ending use and resolving questions
You may stop using Emberday at any time. If you want to remove your information, follow the in-app and iCloud deletion steps before uninstalling, and separately request deletion of support correspondence if desired. Provisions concerning rights in content, licenses, legal responsibilities and unresolved requests continue where relevant.
Contact support first if you have a concern about these terms or the service. These terms do not impose mandatory arbitration, a waiver of collective rights or a particular exclusive court. Applicable law determines your legal rights and the available dispute forum.
Updates to these terms
We may revise these terms as the services or legal requirements change. The effective date identifies this version. Material changes will receive any notice and consent required by applicable law. If you do not agree to an updated version, stop using the affected service.
